Tire warranty question, opinions wanted

My sister has a leaky tire under warranty (America's Tire). Leak cannot be fixed so they're replacing the tire. Her tire is discontinued, so she gets a different tire. Should they not replace both tires on the axle? I know they'll refuse to do that, but I also know that if she were to walk in off the street and ask for one tire replaced they'd STRONGLY advise against replacing only one, especially if the tire is discontinued.

Optimally you are correct but that is for extreme driving. I'd say for everyday usage same size (measure although stated (stamped on sidewall) as such all tires are not the same size) she will be fine.
