Wife got a speeding ticket today

and I'm hiring an attorney. I haven't seen the summons but she says the cop wrote her for 78 mph. She says the limit is 65 mph and I'm thinking the stretch of road she was on is posted 55 mph. At the scene there were three cops cars and she said they searched her car. She says she thought she had to let him search it. She hasn't had a ticket in eighteen years, what should I look for when considering an attorney to represent her?

Why the lawyer? What do you plan on contesting? Unless I am missing something she was in the wrong and the ticket will stand. I'm sure they asked something along the lines of "do you mind if we look in the car?", so they are clear to search the vehicle. Kinda of a given to let them. If you say no, they typically will not be amused and many times will call for a drug dog for which you get to sit and wait quite a while. Just say sure and go on with your life.

Just have her go to court and ask to go to traffic school. Pay the fine and school cost and move on. The ticket won't hit her record this way. It's only a financial hit.

wow, I'm not expert at all but my son got one of those tickets. I think very close to the same speed. 70-something in a 55. They threw in a reckless driving charge due to the speed.
Anyway, he went to court on the date given hoping to just pay a fine and have the points on his record and suffer the increased insurance cost and just live with the consequences. He was even prepared to lose his licence for a period of time as was entirely possible. The DA said on that first court appearance he needed time to think about what he thought he should do. He even indicated that he didn't think the normal options would do. They did a continuance for about a month or two later. So we too thought we better get a lawyer, it seemed like they were thinking of throwing the book at him. Or at least that's what we were dreading. We spoke to a lawyer and he surprisingly told us that he thought it was a scare tactic because he is young and had no prior tickets. He suggested we go without a lawyer and ask for probation and driving school. He told us they would probably drop the reckless driving and just stick him with speeding. So we took his advice. The next court appearance, DA suggested to the judge, community service. So he had X hours of community service (he volunteered at the animal shelter on weekends). I don't recall now how many hours it was but it wasn't that bad. The DA dropped both charges and there was no fine if he agreed and went back at an allotted date to show that he did the community service. I think he had 90 days to complete it. He ended up with no tickets or any "points" on his licence. No record it ever occurred and no fines.

Hmmm...Pretty sure unless you are 30 over the speed limit there is no reckless charge applicable on a normal roadway. At least here in IL. We have a few men in blue here so they can chime in to correct if I'm wrong. I know I was gunned somewhere in triple digits once and the cop wrote me up for 90 (in a 65) so I didn't get really roasted and lose my license. He really liked my car.

15?! I'm never going to Kentucky again. 15 over is the standard cruise rate on pretty much any highway I drive on across the country.

That's the minimum you have to go over to keep up with while driving in LA. It only really happens in the middle of the night on a Wednesday....

I googled reckless driving in Kentucky and got this----"Reckless driving occurs when you are caught driving more than 25 miles per hour over the legal speed limit".

I got this from the DMV.org

KY defines serious traffic offenses as:

  • Speeding 15 mph or more over the speed limit.
  • Driving carelessly or recklessly.
  • Changing lanes in an erratic or improper manner.
  • Driving too closely behind another vehicle.
  • Committing any violation that shows wanton disregard for another person's or property's safety.

I'll be rolling through Kentucky about this time tomorrow..better watch my speed.

Also, here in Mi a first time offender can go to traffic school and have the ticket wiped clean, it may only apply to new drivers though.

Wow. I'll be traveling the country next year, I'll certainly ask you guys for such advice then about local driving
