if it were a 9" the rear housing cap would have a bulge for the larger 9" ring gear. also, the 8" had the extra reinforcing ribs like the "N" case 9". only exceptions to these are the late 50's 9" with the "WAR" chunk. those were brittle chunks & not recommended. the early housings had a smooth cap without the bulge also...

pretty sure the 9" pinion sat lower in the unit vs. the 8"also...
 
Can you get a socket on the bottom two bolts? If you can it's an 8", if not then it's a 9".

+1, this is the easiest way to ID 8" vs 9"
 
there is a seller here advertising it as a 9 inch from a 69. I asked for pics and this is all i got.

From the pic, it sure looks like there is room.
