Toss a bottle of vodka in the yard and wait for your opportunity to change the locks. :roll

You could always take out a restraining order....although that might back fire and have you moving out since she has no means.
 
I thought more and more about the judgement and realized that what he really was saying was that no matter how stupid the laws are, the fact remains that unless there is physical or sexual abuse, there is no cause for an emergency. Because I accepted her drinking (in the hopes she would get well...) for so long and because there is no actual current threat to the kids (I think differently...) he said I cannot move forward with the emergency order. I can file it in regular court...just not as an ex parte (emergency).
I didn't lose. Things just keep the same for now. Hence the need for a lawyer. I unfortunately need someone who can navigate the legal system here and make sure that by being the father and being a man doesn't get me hosed. I have rights just as she does. I just have to be able to prove to a judge that there is a pattern of behavior that is dangerous and that the kids are my primary focus.
Hope to meet with some lawyers next week to see which is a good fit for me and my case.

Sorry to hear it didn't work out. An attorney should be able to get things going in the right direction.

My dad actually went through the same thing in 1972. His ex wife was an alcoholic and neglected all the kids. He got an attorney and went through the courts. He ended up with sole custody of all 5 kids and the house and tossed her out. If he could do it back in the 70s, I'm sure you can. Just keep moving forward and I'm sure it will work out.
 
Sorry to hear. IMO the court systems are now a joke. They are more concerned about protecting the those that are wrong than those that are trying to do right. I see this every day. You could always do a "Drew Peterson". :sarc

You have my sympathy for what you are going through and speaking as a dad who was made a poster child by the court and my ex-wife and her attorney. You need to hire one that will serve the best interest of you and your children. Dont worry so much about how much a very strong, agressive family law attorney will cost as much as getting the result you want (and need). Hire one that is an SOB and go forward.
