Well that ruined my day

Our Lexus just got repo'd. Freaking lovely. 1 day late on payment (auto title loan) and WHAM.. take your car. Good thing Gertrude is in the garage. They can't tow her!
 
Hard to believe they'd repo it after one day. Is this not the first time it's been late? Set those up on an auto pay with the bank so they are never late. Late payments will hose your credit quick.

Without auto pay these days, I'd forget half of my bills!

It's all about fine print with title loan places. Some give you a grace period of 14 days.. some will say 1 day late and they take the car. Guess this place is the one day late kind of folks. :shrug This place wants cash paid every 2 weeks. They don't accept credit cards, debit cars, checks. You have to walk in and pay cash when doing payments. Which we have been doing the last 4 months. Every 2wks, that afternoon before he gets off work, hubby stops by the ATM, pulls out $200 cash and goes and pays. Except yesterday because his boss kept him late at work and he had to be in English class at 5:30pm and we only had one drivable car, the Lexus. My sebring has no brakes again.
 
I'd be pulling those loan papers real fast to check out a few things. First being the default clause(s). As Mark says, one day late should not rise to the level of repo. Even if by one day late you mean, 1 day after 30 (into the next billing cycle). Second, to see what was required to get things square and my car back. Many times those types of contracts can allow things to escalate real fast to the point it no longer even pays to try and recover the car. I wouldn't be surprised that on top of the late payment and it's fee, they will also require reimbursement for the repo costs (which will include storage), but also additional fees and penalties. The faster you react the much better off you will be.
 
My husband is trying to get things straight as the loan for both the titles of the Lexus and Gertrude are in his name. We were going to pay the whole loan off (both cars) when we got our income tax return. Which should be Thur or Friday. Since Gert's title was in my name, I had to sign it over to my husband in order for him to get the loan on both cars, and I told my husband straight up if something happens and they take MY mustang I will rip him a new butthole.
 
Thanks. I'm sure it will. Besides.. it's only my husbands Lexus. Who cares. LOL If they touch my mustang..then there will be some problems. Of course they can't get to Gert anyway since she's in my garage and they can't tow her in the shape she's in. :part
 
And now the poor repo guy will end up getting sued and probably lose everything to this idiot's family.
 
Should have just let the car go, if it was a mixup handle it later, nothing to die over. I feel bad for both the family of the lady and the repo guy, dude was just doing his job.
 
Once the repo guys find it, they pretty much can do/use what ever force necessary to gain possession of their property.

Found out what the problem is/was. Hubby went to their office yesterday after work. According to their records, a payment wasn't made 4 wks ago. :wtf Yes it was because *I* paid it. I clearly remember hubby asking me to stop by the ATM and go pay the car people because he wasn't going to have time to stop by after work before class. And I did. I went there right after I picked my daughter up from school because the office is like 3 blocks away from her school. That was the day their computers were being stupid.... and they said I had to pay exact amount because they couldn't access money to give back change. I remember having to dig through the car for like 47 cents to pay the exact amount. Luckily hubby tosses change in the car so there was a nice pile of pennies and I remember my daughter and I were laughing about his coin collection in the car. They gave me a receipt which of course I put in the console in the Lexus. :hide We could get it out to show them IF they decide to tell us where the car is which they don't seem to want to do. Guess they are worried we might try to take the car. :shrug

They even asked hubby what was up because we've never been late on payment before. Now they are saying to get the car back, we have to pay off the loan (which was less than $1000 before this) but now they are saying there is $180 collection fee AND a $400 repo fee so to get it back we have to pay $1500. I don't fricking think so. :no I be damned if I pay them that $580 for their screw up.

On the upside of things... they haven't mentioned the Mustang. :roll That's the funny part because we got twice as much for the mustang title than we did for the Lexus. And that's after they inspected and looked Gertrude over. Go figure! LOL

So yeah..that's the problem. They screwed up. Not us.
 
OK, Kat you have the right to gather your property from the car. You need to exercise that right and get that receipt if it exists or find the clerk and get them to tell the truth. It will take time but may save you $580.00

sounds like a very iffy place. What kind of place just excepts cash these days and no other form of payment?

Sounds like a place that helps out those with bad credit. Not everyone can have a credit score of 800. :sarc

Not only should you not pay the $580, Once you prove they screwed up, you should be compensated for the inconvenience they caused you. Its nice that they asked your husband what was up AFTER they repoed the car! Hard to believe a good paying customer would not even get a call beforehand!
